Official Terms and Conditions for “#BnBSayCheese” to win Free Grilled Cheese for a Year Contest
No purchase necessary to enter to win. Must be 18 years of age or older to enter.
1. ENTRY REQUIREMENTS
The “#BnBSayCheese” win Free Grilled Cheese for a Year Contest (“Contest”) is designed to give people ages 18 and over the chance to win one free Return of the King Grilled Cheese Sandwich ($8 value) per day for one year. The Contest will be held online from 12:01 am Eastern Daylight Time (“EDT”) April 1, 2018 (“Contest Start Date”) to 11:59 pm EDT April 30, 2018 (“Contest End Date”). Contest is sponsored by Books & Brews, 9402 Uptown Drive #1400, Indianapolis, IN 46256 (Sponsor) who is solely responsible for all aspects of this contest. Under no circumstances is Instagram to be considered a Sponsor.
2. ELIGIBILITY
The Contest is open to all individuals who are legal residents in the United States and Washington D.C., who are at least 18 years of age by Contest Start Date. Individuals submitting a photo on Instagram will be known as (“Entrant”). Contest is void outside of the 50 United States, Washington D.C., and where prohibited. Sponsor’s families and immediate families are not eligible to enter. Sponsor employees are not eligible to enter. Entrants must be the rightful owner of the account(s) the Contest is submitted. Sponsor reserves the right to verify eligibility of any potential winner. Winning a prize is contingent upon meeting all requirements set forth herein. Entrants who do not meet those requirements will be disqualified, and their submissions void.
3. HOW TO ENTER
As of Contest Start Date, Entrants can provide their email address in-store, or submit a “selfie” on Instagram (“Submissions”). For entries to be eligible, Entrants must completely and accurately enter all information to enter the Contest. Submissions must be based on official #BnBSayCheese win Free Grilled Cheese for a Year Contest rules and regulations, available at: official rules. Entrants may enter the contest by providing a valid email address inside participating locations. Entrants may also enter, up to once a day during the duration of the Contest, by taking a “selfie” in a participating location, “checking-in” to the establishment, and using the hashtag: #BnBSayCheese and posting to Instagram. Entrants Instagram must be set to public to qualify. All submissions must be received by 11:59 pm EDT on April 30, 2018. Sponsor is not responsible for late or unsuccessful attempts to enter. The Entrant should be able to provide, upon request, all third-party clearance, releases, and permissions for photo submission, including releases from the entrant and any other third-party participants. Submissions must not contain material which is sexually explicit, obscene, violent, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, etc.) offensive, threatening, profane or harassing. Submissions must not contain any mention or performance of copyrighted media production including but not limited to music, television, books, or television programming. Submissions must not contain material that infringes on international copyright rules and regulations. Once submitted, all submissions become exclusive property of Sponsor, its parent, affiliates, and subsidiaries, in perpetuity.
4. INTERNET LIMITATIONS OF LIABILITY
Sponsor assumes no liability for any error in transmission, communications line failure, theft, destruction, or alteration of entries. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR ANY OTHER REMEDIES FROM SUCH PERSON (S) TO THE FULLEST EXTENT PERMITTED BY LAW.
5. RIGHTS IN SUBMISSIONS
In consideration of Entrant’s photo being reviewed and evaluated for this contest, Sponsor has exclusive rights to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete, or display any such submission, or any portion thereof, in any and all media including but not limited to all forms of internet, television, and wireless protocol. Each Entrant authorizes the Sponsor and any entities affiliated with the Sponsor to utilize the photo submitted to the Sponsor, for eternity and for how they see fit, in connection with the Books & Brews campaign and any of the Sponsor’s programs, including any programs of its affiliates, subsidiaries, franchisees, and licensees, and to make derivative works from such materials at the sole discretion of Sponsor. The Grand Prize Winner may be required to complete and execute additional documents and have third parties execute Sponsor’s documents in connection with the rights granted to Sponsor as a condition of prize acceptance. In addition, by participating in the Contest and submitting a photo, each Entrant hereby grants permission (except where prohibited by law) for the Sponsor to use Entrant’s photo, name, likeness, voice, quotes, comments, biographical information, photograph and/or image for the purpose of advertising, trade, or promotion without further notice, permission, compensation or consideration in any and all media now known, in perpetuity, unless prohibited by law. Entrant can reach contest organizers by e-mail at marketing@booksnbrews.com and at mailing address Books & Brews, 9402 Uptown Drive #1400, Indianapolis, IN 46256 to request that the entrant’s name be removed from the mailing lists for the contest.
6. EQUITABLE RELIEF
Each Entrant understands, acknowledges, and agrees that the Sponsor does not have now or in the future any duty or liability, direct or indirect, contributory, or otherwise, in regards to the infringement of protection of the copyright in and to the submission. Each Entrant acknowledges that, with respect to any claim by Entrant relating to or arising out of Sponsor’s actual or alleged exploitation or use of any Submission or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable Entrant will not be irreparable or otherwise sufficient to entitle such Entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition or other exploitation of the Video or any other production based on or allegedly based on the Submission, and the Entrant’s rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law.
7. PRIZE RESTRICTIONS
A winner cannot assign or transfer any prize to another person. A prize cannot be substituted or redeemed for cash. All prizes are subject to availability. Prize only valid during normal operating hours, not available during store closings due to holidays or natural forces resulting in store closure. If a prize or any portion of the prize cannot be awarded due to circumstances beyond the control of the Sponsor, then a substitute prize may be awarded at sole discretion of Sponsor. Winners are responsible for any risk of loss associated with the prize or any portion of the prize after it has been delivered. Winner will be provided with prize card. Must have provided card at time of purchase and photo ID. Photo ID will be placed in all locations for verification. Each time grilled cheese is redeemed winner must post on Instagram picture at the store ,and check-in, with “Thanks Books & Brews for Grilled Cheese Every Day for a Year” with #BnBSayCheese. This offer is good for dine-in only and cannot be combined with other offers. If winner misses a day to redeem prize, no substitute prize is awarded. The prize is good for one Return of the King ($8 value) per day and may not carry over. Sponsor holds the right to suspend or terminate grand prize if the Sponsor deems the Grand Prize Winner is misrepresenting the terms of the award.

8. PRIVACY NOTICE
Any personal information supplied by you to Books & Brews will be used only to contact the winning Entrants via the email they have supplied when entering the contest. Email submissions in-store may be used to contact Entrants about offers and promotions by Books & Brews. Entrants have the ability to opt-out during submission. By entering the Contest, you grant Books & Brews permission to contact you via your E-mail address solely for the purpose of administration and prize fulfillment. Books & Brews will not sell, rent, transfer or otherwise disclose your personal data to any third party.
